These Terms of Use (“Terms”) govern your access to and use of themilbert.com (the “Site”), a personal photography and life blog about The Milbert. By visiting or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
This is a personal blog. It is not a business offering goods for sale, and it is not financial, tax, legal, or other professional advice. These Terms are general website terms, not a substitute for advice from a lawyer.
Who we are
The Site is operated for The Milbert. Questions: iamthemilbert@gmail.com or the contact page.
The Site
We may change, pause, or stop any part of the Site at any time, including posts, comments, and the contact form. Content is provided “as is.” Stories, captions, and photos are personal and informal. They may contain humor, opinion, or incomplete recollection.
Eligibility
The Site is not directed at children under 13 (or the minimum age required in your country). You may use the Site only if you can form a binding contract and only in compliance with these Terms and applicable law.
Acceptable use
You agree not to:
- Use the Site for unlawful, harmful, harassing, or fraudulent purposes
- Attempt to gain unauthorized access to the Site, accounts, or related systems
- Interfere with security, rate limits, or the operation of the Site (including scraping in a way that burdens the server)
- Upload malware or content that infringes others’ rights
- Impersonate another person or misrepresent your affiliation
- Send spam, advertising, or bulk unsolicited messages through the contact form
- Submit Social Security numbers, financial account numbers, tax returns, or other highly sensitive personal data
Your submissions
If you send a message, comment, or files (including photos) through the Site, you represent that:
- You have the right to send that content
- You have permission from people who appear in photos, and you will not send photos of children without appropriate permission from a parent or guardian
- The content does not violate law or someone else’s intellectual property, privacy, or publicity rights
- The content is not defamatory, obscene, or otherwise prohibited
You keep ownership of content you submit. You grant us a non-exclusive, worldwide, royalty-free license to store, review, copy, and—if we choose—publish that content on the Site and related social or archival uses for the blog. We are not required to use, publish, credit, or return submissions. Photos are not published automatically.
We may refuse, edit, or delete any submission, comment, or published item at our discretion.
Intellectual property
Unless otherwise noted, the Site’s design, text, original photographs, logos, and compilation are owned by us or our licensors and are protected by copyright and other laws. You may view the Site for personal, non-commercial use. You may not copy, scrape, sell, or republish Site content without prior written permission, except for brief fair-use quotation with credit and a link, or as allowed by law.
Theme, plugin, and stock assets remain the property of their owners.
Copyright complaints
If you believe content on the Site infringes your copyright, email iamthemilbert@gmail.com with: (1) a description of the work; (2) the URL of the allegedly infringing material; (3) your contact information; (4) a statement that you have a good-faith belief the use is not authorized; (5) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act; and (6) your physical or electronic signature. We may remove content and, where appropriate, terminate repeat infringers.
Third-party services and links
The Site is hosted on GoDaddy Managed WordPress and may use plugins (including forms and spam tools), fonts, embeds, and email delivery services. Linked or embedded third-party sites have their own terms and privacy practices. We are not responsible for those sites.
Privacy
How we handle personal information is described in our Privacy Policy. That policy is part of how we operate the Site; these Terms control your use of the Site.
No professional advice
Nothing on the Site is legal, medical, veterinary, financial, or other professional advice. Do not rely on the Site as a substitute for advice from a qualified professional.
Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that content (including user-submitted photos) is accurate or appropriate for any purpose.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR HOSTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR FROM CONTENT OR FILES YOU SUBMIT OR VIEW. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.
Indemnity
You will defend and indemnify us against claims, damages, and reasonable expenses (including attorneys’ fees) arising from your use of the Site, your submissions, or your violation of these Terms or of another person’s rights.
Termination
We may suspend or terminate access to the Site, delete content, or refuse submissions at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive.
Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, except that if you are a consumer living elsewhere, mandatory consumer protections of your place of residence may still apply. Courts located in California will have exclusive jurisdiction over disputes, except that we may seek injunctive relief in any jurisdiction. If you are entitled to bring a claim in your local courts, that right is not waived where the law forbids it.
Changes
We may update these Terms by posting a revised page and changing the “Last updated” date. Continued use of the Site after a change means you accept the revised Terms.
